Terms of Use

These Terms of Use (“Terms”) govern your use of the Camera Overlay mobile application, website, and optional cloud-storage service provided by Standard Software Inc. (“Standard Software,” “we,” “us,” or “our”).
By downloading, purchasing, accessing, or using Camera Overlay, you agree to these Terms. If you do not agree, do not use Camera Overlay.
1. Eligibility
If you use Camera Overlay for a company or other organization, you represent that you have authority to accept these Terms on its behalf.
2. Licence to Use Camera Overlay
Subject to these Terms, Standard Software grants you a limited, non-exclusive, non-transferable, revocable licence to install and use Camera Overlay for your personal or internal business purposes on devices that you own or control.
You may not:
- Copy, sell, rent, sublicense, or commercially redistribute Camera Overlay;
- Reverse engineer, decompile, or attempt to obtain its source code, except where applicable law expressly permits it;
- Remove copyright, trademark, or ownership notices;
- Interfere with or bypass security or access controls;
- Use automated systems to overload or misuse the service; or
- Use Camera Overlay for an unlawful, fraudulent, harmful, or abusive purpose.
The terms and rules of the app store through which you obtain Camera Overlay also apply.
3. Purchase and Refunds
Camera Overlay is offered as a one-time paid download.
Camera Overlay does not contain:
- Subscriptions;
- In-app purchases; or
- Advertising.
Payments are processed by the app store through which you purchase Camera Overlay. Standard Software does not directly receive or store your complete payment-card information.
Refund requests are administered by the applicable app store under its policies. Standard Software does not control whether an app-store refund is approved.
4. Local Features
Camera Overlay’s camera, alignment, overlay, and comparison features may be used locally without creating a cloud account.
You are responsible for:
- Managing photographs stored on your device;
- Maintaining sufficient device storage;
- Configuring device permissions;
- Protecting access to your device; and
- Maintaining independent backups of important photographs.
Deleting Camera Overlay or deleting a cloud account may not delete photographs separately saved to your device’s photo library.
5. Cloud Storage
Camera Overlay provides optional cloud storage for up to 50 images per account.
You must authenticate through a supported Apple or Google account to use cloud storage. You are responsible for maintaining the security of your device and authentication account and for activity occurring through your account.
When the 50-image limit is reached, you may need to delete an existing image before uploading another image.
Cloud storage is provided as a convenience and is not intended to be the sole permanent archive for important photographs. You are responsible for retaining independent copies.
We do not guarantee that cloud storage will always be uninterrupted, error-free, or available indefinitely.
6. Your Photographs
You retain ownership of photographs that you take, select, or upload through Camera Overlay.
By uploading a photograph to cloud storage, you grant Standard Software a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, back up, retrieve, display to you, and delete the photograph solely as necessary to provide, maintain, and secure the cloud-storage service.
This licence ends when the photograph is permanently deleted from our systems, except for temporary residual copies maintained as part of ordinary backup or recovery processes.
We do not claim ownership of your photographs and do not use them for advertising, facial recognition, biometric identification, artificial-intelligence training, or unrelated commercial purposes.
7. Your Responsibilities
You represent and agree that:
- You have the right to use and upload every photograph you submit;
- You have obtained any consent or permission required to photograph another person;
- Your use of Camera Overlay will comply with applicable privacy, employment, professional, healthcare, and intellectual-property laws;
- You will not upload illegal, infringing, abusive, or malicious content;
- You will not use Camera Overlay to harass, stalk, exploit, or invade the privacy of another person; and
- You will not attempt to access another user’s account or photographs.
You are solely responsible for determining whether Camera Overlay is appropriate for your particular professional, business, or regulatory requirements.
8. Access to Cloud Information
Standard Software has the technical ability to access information stored within its cloud systems but does not routinely access or view user photographs.
Authorized access may occur only where reasonably necessary to:
- Provide assistance requested by you;
- Investigate or resolve a technical issue;
- Protect the security and integrity of Camera Overlay;
- Investigate suspected misuse;
- Enforce these Terms; or
- Comply with a legal obligation.

9. Account Deletion
You may delete individual cloud images or delete your entire cloud account through Camera Overlay.
When an account is deleted:
- The account and its cloud information are removed from active systems;
- Cloud images may remain in protected recovery storage for up to seven days; and
- Limited authentication records, security logs, and residual backup copies may take up to 180 days to be fully removed.
Deleting your cloud account does not delete photographs stored locally on your device.
10. Suspension and Termination
You may stop using Camera Overlay at any time.
We may restrict, suspend, or terminate access to cloud storage where reasonably necessary because of:
- A material violation of these Terms;
- Illegal, fraudulent, abusive, or harmful activity;
- A security threat;
- Unauthorized access;
- A legal requirement; or
- Conduct that could harm Camera Overlay, Standard Software, another user, or a third party.
Where reasonably possible, we will provide notice and an opportunity to correct the issue or retrieve cloud photographs. Immediate action may be taken where required for security, safety, or legal reasons.
Sections that by their nature should continue after termination will remain in effect, including provisions concerning ownership, disclaimers, liability, and governing law.
11. Medical Disclaimer
Camera Overlay is a photography and visual-alignment tool. It is not a medical device, diagnostic tool, medical-monitoring service, or patient-record system.
The app and its images must not be relied upon to diagnose, treat, or monitor a medical condition or as the sole basis for a clinical or healthcare decision.
Healthcare professionals and other regulated users are solely responsible for determining whether their use of Camera Overlay complies with applicable privacy, consent, security, professional, and record-keeping requirements.
12. Accuracy and Results
Camera Overlay is designed to help users reproduce photographic positioning, framing, zoom, and alignment more consistently.
Results may vary because of device characteristics, camera lenses, lighting, movement, user positioning, operating-system behaviour, and other conditions.
We do not guarantee perfect alignment, identical photographs, exact measurements, clinical accuracy, or any particular professional or commercial outcome.
13. Service Changes and Availability
We may update, modify, replace, suspend, or discontinue features when reasonably necessary to improve Camera Overlay, address security or technical issues, comply with the law, or respond to changes in operating systems and third-party services.
Where reasonably possible, we will provide advance notice before permanently discontinuing cloud storage and allow users a reasonable opportunity to retrieve their cloud photographs.
Updates are provided while Camera Overlay remains actively supported. We do not promise that every feature or service will remain available permanently or work with every future device or operating-system version.
14. Third-Party Services
Camera Overlay relies on services provided by app stores, authentication providers, hosting providers, and cloud-infrastructure providers.
Those services are governed by their own terms and privacy practices. Standard Software is not responsible for outages, changes, suspensions, security incidents, or other acts or omissions of a third-party service outside our reasonable control.
15. Intellectual Property
Camera Overlay, including its software, interface, graphics, branding, text, design, and underlying technology, is owned by Standard Software or its licensors and is protected by intellectual-property laws.
“Camera Overlay,” its logos, and related branding may not be used without prior written permission from Standard Software.
These Terms do not transfer ownership of Camera Overlay or its intellectual property to you.
16. Disclaimer of Warranties
To the maximum extent permitted by law, Camera Overlay is provided on an “as is” and “as available” basis.
Standard Software disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, and compatibility.
We do not warrant that Camera Overlay will:
- Be uninterrupted, secure, or error-free;
- Produce exact or identical photographic results;
- Preserve every cloud image without loss;
- Meet every professional or regulatory requirement; or
- Remain compatible with every device or operating system.
You use Camera Overlay at your own risk and should maintain independent copies of important photographs.
17. Limitation of Liability
To the maximum extent permitted by law, Standard Software and its directors, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.
This includes loss of profits, revenue, business opportunities, data, photographs, goodwill, or anticipated savings arising from or related to Camera Overlay.
To the maximum extent permitted by law, Standard Software’s total aggregate liability arising from or related to Camera Overlay or these Terms will not exceed the amount you paid to purchase Camera Overlay.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
18. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.
You agree that any dispute arising from or relating to Camera Overlay or these Terms will be brought exclusively before the courts located in Ontario, Canada.
19. Changes to These Terms
We may update these Terms to reflect changes to Camera Overlay, our business practices, or applicable requirements.
If a change is material, we will provide reasonable notice through the app, website, or another appropriate method. Your continued use of Camera Overlay after the updated Terms take effect constitutes acceptance of those updated Terms.
The effective date at the top identifies the latest version.
20. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
You may not assign your rights under these Terms without our prior written consent. We may assign these Terms in connection with a reorganization, merger, acquisition, or transfer of the Camera Overlay business.
These Terms and the Privacy Policy constitute the entire agreement between you and Standard Software concerning Camera Overlay, except for applicable app-store terms.
